DAR ES SALAAM: Msofe`s case postponed

The Kisutu Resident Magistrate’s Court in Dar es Salaam yesterday postponed a murder case facing a prominent businessman in the city Marijani Abdubakari Msofe, also known as Papaa Msofe, to November 28, this year.
The decision to postpone the case was reached by the court after prosecution led by State Attorney Leonard Challo informed the court that the investigation had not been completed.
Resident Magistrate, Agnes Mchome decided to postpone the case till November 28, this year.
Msofe is accused of having killed a fellow businessman, Onesphory Kituli last year in a feud over a house, which the deceased had bought on mortgage after making a down payment of 30m/-.
When first charged the accused was not allowed to enter any plea because murder cases are normally handled by the High Court.
In another incident, the court also informed four accused who are charged with two counts including being in possession of government’ properties worth more than 438.9/- that the court does not have a power to hear such economic case as they are normally heard at the High Court.
The presiding Resident Magistrate Stewart Sanga said that after the prosecution led by State Attorney Hamidu Mwanga claimed to the court that the investigation into the case was incomplete and asked the court to set another date for the mentioning of the case.
He said that he couldn’t grant bail to the accused, adding that if they wanted bail they should go to High Court. The accused in the case are Peter Kabi, (41), Leonida Loi Kabi (42), Charles Wainaina (41), and Polisi Malisa (42) all from Kimara Stop Over.
