KENYA: Man, 85, sentenced to life in prison for rape of girl

An octogenarian who defiled two sisters aged nine and six was on Monday sentenced to life imprisonment in absentia.
The 85-year-old has been skipping court since January when the Children’s Court in Nakuru was to deliver judgment in the matter.
Joseph Kamau Githu was accused of defiling the two girls on March 3, 2011, at Jumatatu farm in Subukia, Nakuru County.
Senior resident magistrate Judicaster Nthuku issued a warrant of the octogenarian’s arrest three weeks ago, but the police were allegedly unable to trace him.
The magistrate sentenced Githu to life imprisonment for defilement and 25 years for indecent act.
One of the sisters told the court that they were playing outside the man’s house when he called them in to fetch water.
The girls said that the accused undressed them and started touching their private parts before defiling the elder one.
A doctor who examined the complainants confirmed that the nine-year-old girl had been defiled.
In her ruling, Ms Nthuku noted that the prosecution had proved beyond reasonable doubt that Githu defiled the nine-year-old and indecently touched her sister.
She dismissed claims by the accused that the mother of the two minors wanted to extort money from him by falsely accusing him.
She found the accused guilty and sentenced him to the two jail terms which are to run concurrently.
A warrant was issued for the man’s arrest.
