NAKURU: Court orders TSC to pay ex-teachers Sh3 billion

The High Court has ordered the Teachers Service Commission (TSC) to release Sh3.34 billion to a group of retired teachers.

The orders were made in Nakuru on Thursday during the hearing of a petition against TSC Secretary Gabriel Lengoboini and director of pensions.

More than 52,000 retired teachers had filed a contempt case against TSC for failing to pay them their pensions and salary arrears amounting to more than Sh101 billion despite several court orders by the High Court in Nakuru.

Through lawyer Dominic Kimatta, the ex-teachers said the latest order that TSC had failed to obey was issued on April 14.

However, Mr Justice Anyara Emukule said the respondents may not have been in contempt of court although that had failed to honour the order.

The former teachers sued TSC in 2006 claiming unpaid lump sum salary increment and accrued pension from July 1997 and the court awarded them Sh16.7 billion.

TSC legal affairs deputy director Allan Sitima told the court the claims by had been processed following the ruling but the process could not be completed “since the claims were not supported by documents as stipulated in the pensions Act.”
