DPP holding Msofe, Makongoro murder case file, court told
THE Director of Public Prosecution (DPP) is still holding the police file of a murder case against two prominent businessmen Makongoro Joseph Nyerere and Marijani Abubakar, alias Papaa Msofe, the Kisutu Resident Magistrate’s Court in Dar es Salaam heard on Tuesday.
State Attorney Leonard Chalo, for the prosecution, informed Senior Resident Magistrate Hellen Riwa that they were still waiting other directives from the DPP on how to proceed with the matter. “We, therefore, pray for another mention date while awaiting the directives,” the prosecutor requested.
The magistrate granted the request and adjourned the case to March 25, for another mention. The two businessmen are alleged to have murdered their co-businessman, Onesphory Kituly, in 2011.
It is alleged that the murder occurred on November 6, 2011, at Magomeni Mapipa in Kinondoni District in the city. It is claimed further that such murder was a result of a long pending land dispute involving a house of which the deceased had been at loggerheads with a section of people since 2007. on Tuesday’s court session was little bit cool as Nyerere remained mum as opposed to previous occasions when he used to lament on the prosecution’s decision to join him in the case without having any legal basis.
Nyerere, who is claiming to have been instructed by the court as court broker to evict the deceased from the house since 2006, had been complaining that he has been linked with the murder simply because he refused to offer 8m/- bribe to the prosecution.
Apart from that, Nyerere has been complaining on the inordinate delay by the prosecution to complete investigations in the matter. In all other previous sessions, Papaa Msofe has never opened his mouth to raise any complaint regarding the case he is facing.
